These Terms of Use and Service govern access to and use of our Platform, which includes any website, application or service we offer (the “Platform”), as well as the purchase of tickets to events through the aforementioned Platform.
By accepting these Terms of Use and Service, the user acknowledges and agrees:
In accordance with the provisions of Article 10 of Law 34/2002, of July 11, on information society services and electronic commerce, WECLUB CONNECT SL, as an information service provider, provides the following general information about the Platform it owns.

WECLUB is a platform focused on nightlife. On one hand, we provide nightclubs, party venues, and event organizers with a management platform. Through this platform, they can promote their events and manage ticket sales and other services, as well as venue capacity and staff involved in event promotion and management. On the other hand, the user app is a social network where people can post photos and videos, similar to Instagram, and chat with each other. They also have access to posts from different nightclubs and can directly purchase tickets to the events they want. In some clubs, they can even reserve tables and drinks. The app encourages group entertainment, allowing users, if configured, to see each other’s reservations and which events they are attending.
WECLUB has two types of users.
On one hand, there are nightclubs, party venues and event organizers (the “Event Organizers”) who use a web platform as a Content Management System (CMS) to, through our Platform, register the events they organize and their characteristics and sell tickets and other services for them through our Platform.
On the other hand, we have the end users (the “End Users”) who use our Platform to interact with other End Users and, if they so wish, purchase tickets to events organized by event organizers.
They are all individually referred to as the “User” and collectively as the “Users”.
Users agree to use our Platform and all its content and services in accordance with the law, morality, public order, and these Terms and Conditions, and not to use it for illegal activities, activities that infringe upon the rights of third parties, and/or activities that violate applicable law. By accepting these Terms and Conditions or making a purchase, the user declares that they have the legal capacity to enter into contracts.
Specifically, Users agree to:
WECLUB reserves the right to cancel any transaction and/or terminate a User’s account when there are reasonable suspicions, indications, or evidence that it has been carried out in violation of these Terms and Conditions, without prior notice. The User agrees to indemnify WECLUB against any claim, fine, penalty, court judgment, or sanction that WECLUB may be required to bear as a result of the User’s breach of any of the aforementioned rules of use. WECLUB also reserves the right to seek compensation for any damages incurred.
WECLUB offers nightclubs, party venues and Event Organizers the possibility of using its Platform to promote, advertise and sell tickets and other services and products that can be offered for the events they organize to WECLUB’s End Users.
Specifically, WECLUB offers Event Organizers the following services:
For promotional reasons, these services will initially be provided free of charge, but WECLUB reserves the right to charge for these services in the future, after informing and communicating with the Event Organizers and, of course, after contracting with said Event Organizers of the new service conditions.
WECLUB provides its End Users who access the Platform with the ability to interact with each other, exchanging images, videos, chats, comments, posts, etc. (the “Content”), and the ability to comment on and react to posts. WECLUB is not responsible for the Content that End Users may upload to the Platform; each End User is responsible for their own Content.
In this regard, the End User who uploads and/or publishes any content on the Platform (images, videos, comments, posts, etc.) is responsible to WECLUB for its legality and legitimacy and, where applicable, for having all the legally necessary permissions and authorizations to upload and publish on the Platform the personal data of third parties that appear in the images or videos and/or are mentioned in the comments and posts, granting WECLUB, by the mere fact of uploading certain content to its Platform, the right to publish and process said content to the extent provided in these Terms and Conditions.
Notwithstanding the foregoing, WECLUB reserves the right to remove all content uploaded and/or published by Users on the Platform that WECLUB detects and considers inappropriate, illegal or illicit, or when requested by any interested party.
End Users can choose to have a public profile, in which case they can be followed by any other User on the Platform, or a private profile, in which case they can only be followed by those Users whose friend request they have accepted (“contacts”). They can also activate the tracking of their bookings. If the profile is private, only the End User’s contacts who have activated booking tracking will be able to see them; if the profile is public, all End Users will be able to see these bookings.
Thus, when an End User accesses the Platform through their username and password, they can see the various events published on WECLUB, since the profiles of the Event Organizers are public, as well as the profiles of those other End Users who have chosen to have their profiles public or who have accepted their friend request and, even, the reservations made by the latter.
End Users can unfollow both Event Organizers and other End Users by clicking the unfollow button on their profile. They can also block other End Users from contacting, following, or viewing their profiles.
The purchase of a ticket and/or the contracting of other possible services (such as, among others, table reservations and drinks) for an event through our Platform implies acceptance of two separate contractual relationships: (i) a contractual relationship between the End User and WECLUB relating to the intermediation in the process of purchasing the ticket and the other services of the contracted event, under which WECLUB, as intermediary, provides the End User with the sale and delivery of the ticket and, where applicable, the proof of the services contracted through the Platform; for this service WECLUB charges the End User a commission and (ii) a relationship between the End User and the Event Organizer relating to those aspects related to the organization and execution of the event, under which the said Organizer provides the End User with the event under the terms and conditions under which they have acquired a valid ticket for attendance; for this service the Event Organizer charges a price directly from the End User.
Each event has its associated prices in its booking section. This way, when an End User decides to purchase a ticket and, if applicable, other services for a specific event, the Platform will provide a detailed summary of the ticket price, the cost of any services contracted with the Event Organizer, and the fee WECLUB charges for its intermediation services before payment.
When making a reservation, invitations can be extended to other End Users. In these cases, payment for these reservations can be split among the End Users included in the reservation or made in a single payment, at the End Users’ discretion. Those invited to a reservation not made by them may, in any case, decline the invitation and/or the payment offered by the End User who made the reservation.
Once the End User has chosen the event they wish to attend and the services they wish to contract, payment is made by bank card, Apple Pay, or Google Pay, and is processed through the STRIPE payment gateway (link to STRIPE). After payment is processed, a QR code will be generated granting access to the event, subject to the terms and conditions stipulated by the Event Organizer, as WECLUB has no involvement or responsibility in relation to the event.
Once an End User makes a payment, the STRIPE payment gateway, as part of the intermediation services contracted with WECLUB, will handle the payment to the Event Organizer for the services contracted for that event, and to WECLUB, the corresponding commission for our intermediation services. In addition, STRIPE will also send the End User an invoice from WECLUB for the commission charged for the intermediation service, and another from the Event Organizer for the amount of the services contracted for the chosen event.
Users are responsible and warrant to WECLUB that all information provided to WECLUB about themselves will be true, accurate, current and complete and that they will keep such information updated at all times.
Each User is responsible for maintaining the confidentiality of their password and account details and is fully responsible to WECLUB for all activity that occurs on their account, undertaking to notify WECLUB of any unauthorized use of their password or account or any other breach of security.
Children under 14 years of age must refrain from using our Platform without the assistance and consent of their parents or legal guardians.
In the case of minors between the ages of 14 and 18, the collection and processing of their personal data will be based on their consent, except in cases where the law requires the assistance of the holders of parental authority or guardianship.
All content on the Platform, including but not limited to text, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source code, are the intellectual property of WECLUB or third parties, and no rights of exploitation recognized in current intellectual property regulations may be understood as being transferred to any User.
The trademarks, trade names or distinctive signs published on the Platform are also owned by WECLUB or third parties, and none of their rights over them may be understood to be transferred to any User.
WECLUB does not represent the owners of the brands or the services or products for which it acts as an intermediary in contracting.
WECLUB cannot guarantee that the Platform will always be available, uninterrupted, secure, free from errors or viruses, or that it will not contain mistakes or omissions.
WECLUB will not be liable for any delay or failure of the Platform due to force majeure or causes beyond our reasonable control, including, but not limited to, failures due to unforeseen circumstances or causes outside our control, such as acts of war, terrorism, riots, embargoes, actions of civil or military authorities, fire, floods, accidents, strikes, epidemics or other natural disasters, shortages of transport services, fuel, energy, manpower or materials, or breakdowns in public or private telecommunications networks.
WECLUB acts as a mere intermediary in the sale of tickets and other additional services for attending nightclubs, party halls, shows and/or, in general, events organized by the Event Organizers.
Therefore, when an End User purchases a ticket for an event through our Platform, the contract is entered into with the Event Organizer and not with WECLUB. WECLUB does not organize or exercise any control over the events that End Users book through its Platform and, therefore, WECLUB is not liable to the End User or any third party for access to the event, its terms and conditions, the event itself, or any delay, suspension, cancellation, modification, or any other circumstance that may give rise to a claim related to the event. This liability rests exclusively with the Event Organizer, and by accepting these Terms and Conditions, the End User agrees that any claim they make for any of the aforementioned reasons will be directed exclusively against the Event Organizer and never against WECLUB.
For these purposes, when an Event Organizer uploads an event for promotion on the Platform, they must include a description of the event, as well as its characteristics, terms and conditions (such as date and time of the event, description, ticket price, minimum age to attend, dress code, ticket price refund policy, reservation of the right of admission, etc.).
The exclusion of liability provided for in this section shall not affect in any way the liability that, depending on the nature and characteristics of the services provided in each case by WECLUB and the type of User to which it relates, WECLUB has to assume in accordance with the mandatory provisions of the legislation for the protection and defense of consumers and users in force in Spain or in any other Spanish legal regulation.
In the event of any disagreement between the Organizers of an Event and any End User who has purchased a ticket or service for said event, the decision to refund or not the price paid will correspond exclusively to the Organizer of the Event.
Notwithstanding the foregoing, WECLUB, following in all cases the instructions provided by the Event Organizer, will proceed to refund all or part of the price (according to the instruction received from the Organizer), through the Platform and the STRIPE payment gateway.
Event Organizers, by using the WECLUB Platform to promote and sell the events they organize to End Users, agree to comply with and respect the Terms and Conditions set forth in this document, and declare that they know and accept the following WECLUB Privacy and Cookies Policy (LINK to said Privacy Policy).
When an Event Organizer uploads an event for promotion on the Platform, they agree to include a description of the event, as well as its characteristics, terms and conditions (such as date and time of the event, ticket price, minimum age to attend, dress code, ticket refund policy, reservation of the right of admission, types of drinks and other services that can be purchased, etc.). They also agree to respect these characteristics, terms and conditions with respect to End Users.
They are especially responsible for all claims that may be made by End Users who have purchased tickets and contracted services for the aforementioned events through the Platform, due to a breach or defective compliance with the terms, conditions and characteristics of said events and/or services that they have uploaded to the platform.
For these purposes, the Event Organizers acknowledge that WECLUB does not intervene in any way in the organization nor has any control over the access, execution, delay, suspension, cancellation, modification, annulment and/or any other circumstance related to the event or with the fulfillment of its characteristics, terms and conditions uploaded to the Platform by the Event Organizers, and therefore exempt WECLUB from any liability arising from any of these reasons and guarantee its full indemnity for any claim that any third party may direct against WECLUB for any of the reasons mentioned in this paragraph.
For its part, WECLUB undertakes to provide Event Organizers duly registered and accepted on the Platform, the services described in section 5 (“Services for Event Organizers”), subject to the Terms and Conditions provided in this document.
Although WECLUB initially provides these services free of charge, it reserves the right to charge for them in the future, after informing and communicating with the Event Organizers and, of course, after contracting the new service conditions with said Event Organizers.
End Users, by using the WECLUB Platform, agree to comply with and respect the Terms and Conditions set forth in this document, and declare that they know and accept the following WECLUB Privacy and Cookies Policy (LINK to said Privacy Policy).
In particular, the End Users declare, know and accept that WECLUB does not intervene in any way in the organization nor has any control over the access, realization, delay, suspension, cancellation, modification, annulment and/or any other circumstance related to the event for which the End Users have purchased tickets and services, nor with the fulfillment of its characteristics, terms and conditions uploaded to the Platform by the Event Organizers, and therefore exempt WECLUB from any liability arising from any of these reasons.
End Users acknowledge and accept that the Event Organizers are solely responsible for all such services and activities related to events and, consequently, waive any right to make any claim against WECLUB for any of these reasons.
Notwithstanding the foregoing, End Users may contact WECLUB to obtain information on how to contact Event Organizers to make any complaints they deem appropriate.
For its part, WECLUB undertakes to provide duly registered and accepted End Users on the Platform, the social networking and ticketing services and other services described in sections 6 and 7, subject to the Terms and Conditions provided in this document.
Regarding the purchase of tickets and other services for events, it is expressly stated that the End User may not exercise the right of withdrawal or resolution provided for in the regulations for consumers and users, as this right is excluded for services related to leisure or recreation activities, in accordance with the provisions of article 103.I) of the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.
Users can submit their complaints, claims and requests for information by sending a written request to the email address info@weclubconnect.com or to the postal address at Calle Fernando Rey 10 Edificio RPG. 28223. Pozuelo de Alarcón-MADRID.
WECLUB will respond to claims received as soon as possible and, in any case, within one month of the submission of the claim.
If any section of these Terms and Conditions is declared wholly or partially invalid, such invalidity will only affect that section or the part thereof that has been declared invalid, with the remainder of these Terms and Conditions remaining valid in all other respects.
These Terms and Conditions will be available to Users on the Platform.
WECLUB reserves the right to modify them at any time, notifying Users of such modifications by publishing the updated terms and conditions on the Platform.
These Terms and Conditions shall be governed by and construed in accordance with applicable Spanish law.
In the event of any claim, controversy, or dispute relating to these Terms and Conditions or any of the services provided by WECLUB, and if an out-of-court settlement is not possible, the parties submit to the exclusive jurisdiction of the courts of Madrid. However, if the User is a consumer, they may file the claim in the city where they are domiciled, in accordance with applicable law.
